Sale Agreement

Please read this sale agreement carefully before submitting your buyback order from our website. Please be aware that by submitting an order with us, you agree to be bound by these terms and conditions and our terms of use.

You should keep a copy and print these terms and conditions and the terms of use for your future reference.

Our contract between moonwebsolutions.com and you

Our buyback service is intended for residents within the United Kingdom and at any point we reserve the rights to be able terminate any service outside of these boundaries.

Upon placing your order on mac4money.com you will activate your contract with us. It will incorporate these terms and conditions and our terms of use.

By using our service, you are confirming that you own all rights, title and interests in any device (inc. Tablets, Watches, Computers and Laptops) that you send to us.

Upon us receiving your sent device, all ownership of the device(s) will then pass to us and in accordance with these terms and conditions, a contract will be formed.

The contract between you and us is binding on you and us and on our respective successors and assigns

You may not transfer, assign, change or otherwise dispose of this contract, or any of your rights or obligations arising under it, without our prior written consent.

We have the rights to transfer, assign, change, sub-contract or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time during the term of the contract.

If you wish to cancel the contract between us, you have a cooling-off period between placing your order and sending the device.

In order for you to cancel your contract between us you must notify us in writing.

When cancelling during the cooling-off period, you do not need to give us any reason for cancelling the contract, and we will not charge you any administration charges.

To cancel the contract you must notify us in writing.

Other than if the device does not meet our terms and conditions (see below), this contract cannot be cancelled after you have sent your device(s) to us (outside the "cooling-off period").

Please ensure you are rightful owner of the device and make sure you are happy to send us the device

Consumers

For the purposes of these terms and conditions, "consumer" means an individual who neither makes this contract on behalf of any business, as defined by the Unfair Contract Terms Act 1977.

By placing an order through mac4money.com you are confirming that:

  • You are resident in the United Kingdom
  • You are accessing our site from the United Kingdom
  • You are legally capable of entering into a binding contract
  • You are 18 years old or older

Should any breaches of this contract arises, you release us of any liabilities or claims that may arise.

Businesses

If you are placing an order through our site acting as on behalf of a business you warrant that:

  • You are fully authorised to act on behalf of the registered business
  • You are based in the United Kingdom
  • You are accessing our site from the United Kingdom
  • You have the legal capabilities of entering a binding contract.
Devices

Each device sent to us (inc. Tablets, Watches, Computers and Laptops) should match the make and model in the sale order and match the following stated conditions:

Brand New

Each device should be as described below:

Be fully functional*

Be packaged and sealed in original manufacturer packaging the box should not be opened and the tamper proof seals should be intact

Have all accessories included in original sealed packaging

*Must turn on and off, with all buttons and ports undamaged and fully operational. All features such as Camera, Wi-Fi, Video, making calls, etc must function. Operating system (software) must be fully loaded and not iCloud locked, not pin protected and all security settings have been cleared. Screen and touchscreen must be fully operational. Battery capacity must be very good.

Excellent / As New

Each device should be as described below:

  • Be in immaculate condition as if new packaging not required
  • Be fully operational*including Screen; Keyboard; TrackPad; all internal components; ports; drives and software
  • Have no scratches: no scratches at all, no cracks, dents, and no missing parts).
  • Have no marks/blemishes on-screen; dead pixels; pressure marks liquid damage or screen rub; backlight works to full brightness.
  • Not have loose or damaged hinges.
  • Be of UK Specification
  • Come with genuine, working, complete, undamaged power supply.
  • Maintain a charge after the charger has been removed.
  • Not overheat or have a noisy fan.
  • Have no liquid damage
  • Not be password protected

*Must turn on and off, with all buttons and ports undamaged and fully operational. All features such as Camera, Wi-Fi, Video, making calls, etc must function. Operating system (software) must be fully loaded and not iCloud locked, not pin protected and all security settings have been cleared. Screen and touchscreen must be fully operational. Good

Each device should be as described below:

  • Be fully operational* including Screen; Keyboard; TrackPad; all internal components; ports; drives and software.
  • Have only very light scratches: Lights scratches are acceptable (no cracks, dents, missing parts).
  • Have no marks/blemishes on-screen; dead pixels; pressure marks liquid damage or screen rub; backlight works to full brightness.
  • Not have loose or damaged hinges.
  • Be of UK Specification
  • Come with genuine, working, complete, undamaged power supply.
  • Maintain a charge after the charger has been removed.
  • Not overheat or have a noisy fan.
  • Have no liquid damage
  • Not be password protected

*Must turn on and off, with all buttons and ports undamaged and fully operational. All features such as Camera, Wi-Fi, Video, making calls, etc must function. Operating system (software) must be fully loaded and not iCloud locked, not pin protected and all security settings have been cleared. Screen and touchscreen must be fully operational. Poor but still working

Each device should be as described below:

  • Power on* (screen must switch on and not be blank)
  • Include its battery (charger not required)
  • Be intact (not crushed or snapped in half)
  • Not have bent housing
  • Not have any missing parts or components
  • Device is not functioning properly including Screen; Keyboard; TrackPad; all internal components; ports; drives and software.
  • No major dents; No major cracks; No missing plastics.
  • Screen is fully intact with no cracks or bruising
  • Battery still holds a charge
  • No liquid Damage.
  • Not password protected

*Must turn on and off, with all buttons and ports undamaged and fully operational. All features such as Camera, Wi-Fi, Video, making calls, etc must function. Operating system (software) must be fully loaded and not iCloud locked, not pin protected and all security settings have been cleared. Screen and touchscreen must be fully operational.

Faulty / iCloud locked

Each device should be as described below:

  • Does not power on
  • Battery does not hold a charge
  • Screen cracked or bruised
  • Bent or dented housing
  • Not have any missing parts or components
  • Operating system will not load
  • Touch screen or camera does not work

Example of broken: Does not power on, Blank Screen, Water damaged, Shattered touchscreen, Major defect in the screen, Faulty operating system, Faulty camera, Faulty touchscreen, Faulty Wi-Fi, Poor battery capacity, Faulty charging port, etc.

Please note:

  • We accept power adapters, chargers and accessories. But these will not increase the value of your order.
  • By submitting an order through our site you warrant that the phone(s) and/or devices(s) comply with these terms.
  • If a device does not meet our terms and conditions, we will propose an adjusted price by email. If you choose to decline our new offer, we are happy to return the device to you free of charge. If you do not reply to our proposed offer email within 14 days, we will pay you the new adjusted price.
Data Protection

By using our website and sending your device to us, you are agreeing to release us from all and any claims, losses or damages with respect to the device. You will not hold us liable for any data stored or contained upon memory cards or any storage media in conjunction with the device (this includes, SMS, photos, games, songs or other data ). We accept no responsibility in relation to the security, protection, confidentiality or use of such data. Please ensure you remove all data prior to sending us the device.

Whilst we are confident all of our security measures are sufficient to prevent any data breaches, we advise you strongly to ensure your device has been factory restored.

If your device is non-functional and has a "remote wipe" function, then we strongly advise that you attempt wiping the device prior to sending it to us

With non-functioning devices, you may not be able to use any data erasure tools. In this scenario, you must be aware of the risks involved in sending us a data baring device. Upon receiving the device, we will destroy all levels of data using our industry-approved methods.

We do not accept any liability in respect of the security, protection, confidentiality or use of Data included on any devices sent to us.

Sim Card removal

You are responsible for the removal of any sim cards installed within a device. We are unable to return any sim cards should you not remove them prior to sending.

We will not be held liable for any accounts or contracted tariffs associated with any sim cards sent to us. We will destroy all sim cards that we receive.

Lost or Stolen Mobile Phones and Devices

Selling a device that has been reported lost or stolen is a criminal offence and we check every device sent to us through the CheckMEND (buybackdevice) database of lost and stolen property records to ensure no lost or stolen items are purchased.

If a device we receive has any criminal activity associated with it, we are obliged to inform you through email and ask you to contact CheckMEND to prove that you are the rightful owner of the device and clear the records.

Once the device is clear of any records, we will process your payment.

However, should the device not be cleared on CheckMEND within the Quarantine Period, we are required by law to hold the device, pass it to the Police or other law enforcement body or dispose of it.

By entering this contract, you agree to these actions.

Pricing

The prices we offer on mac4money.com are subject to change at any time without notice.

Our prices include VAT.

We guarantee our quoted prices for 14 days from the 'Order Confirmation' date. If we receive your device after 14 days from the 'Order Confirmation' date, a revised price may be issued. We will notify you by email and you have a further 14 days to approve the revised price.

Postage & Packaging

We use DPD couriers to collect and provide the packaging for your device. Whilst we use a reliable and insured service with DPD we cannot be held liable for any losses whilst your device is in possession of any courier service.

Please note you will be covered up to:

  • £100.00 with DPD

Payments

We offer three options of PayPal, cheque or bank transfer. You will be able to select your preferred option upon agreeing to your sale price. We are unable to change your chosen method of payment once the selection has been made during the sale selection.

Upon receiving your device(s), we will check the device model, specification and condition, and ensure it meets our terms and conditions. Providing it does, we will endeavour to make the payment to you, via your chosen method within 72 hours following receipt of the device (Monday to Friday, excluding public holidays).

Cheque

Cheque payments will and can only be made to the name and address given upon registration.

Cheques must be deposited within 6 months of the issue date.Please note, your bank cannot and will not accept your cheque if it is over the 6-month period.We are unable to issue a replacement cheque after 6 months.

Bank Transfer payments

We will only issue bank transfer payments to the account details given when placing your online order. We cannot, under any circumstances, recall or reissue bank transfer payments once they have been made.

Rejected offers

If you reject an amended offer for your device, we will return your device/s free of charge. We will contact you first via your given email address and give you 14 days to approve or reject your offer. Please allow 3-5 working days to receive your device. Deliveries will be attempted three times and if the final attempted delivery fails then we will contact you to arrange your own collection of your device. If there is no contact for 7 days, we will automatically process your payment at the amended price.
